German court rules religious circumcision on boys an assault

Well there ya go. go germany hey? Need to make more anti-dangerous-religious crap laws everywhere.

BERLIN — Circumcising young boys on religious grounds amounts to grievous bodily harm, a German court ruled Tuesday in a landmark decision that the Jewish community said trampled on parents' religious rights.

The regional court in Cologne, western Germany, ruled that the "fundamental right of the child to bodily integrity outweighed the fundamental rights of the parents", a judgement that is expected to set a legal precedent.

"The religious freedom of the parents and their right to educate their child would not be unacceptably compromised, if they were obliged to wait until the child could himself decide to be circumcised," the court added.

The case was brought against a doctor in Cologne who had circumcised a four-year-old Muslim boy on his parents' wishes.

A few days after the operation, his parents took him to hospital as he was bleeding heavily. Prosecutors then charged the doctor with grievous bodily harm.

The doctor was acquitted by a lower court that judged he had acted within the law as the parents had given their consent.

On appeal, the regional court also acquitted the doctor but for different reasons.

The regional court upheld the original charge of grievous bodily harm but also ruled that the doctor was innocent as there was too much confusion on the legal situation around circumcision.

The court came down firmly against parents' right to have the ritual performed on young children.

"The body of the child is irreparably and permanently changed by a circumcision," the court said. "This change contravenes the interests of the child to decide later on his religious beliefs."

The decision caused outrage in Germany's Jewish community.

The head of the Central Committee of Jews, Dieter Graumann, said the ruling was "an unprecedented and dramatic intervention in the right of religious communities to self-determination."

The judgement was an "outrageous and insensitive act. Circumcision of newborn boys is a fixed part of the Jewish religion and has been practiced worldwide for centuries," added Graumann.

"This religious right is respected in every country in the world."

Holm Putzke, a criminal law expert at the University of Passau, told the Financial Times Deutschland that the ruling was "enormously important for doctors because for the first time they have legal certainty."

"Unlike many politicians, the court has not allowed itself to be scared off by charges of anti-Semitism or religious intolerance," added Putzke.

The World Health Organisation has estimated that nearly one in three males under 15 is circumcised. In the United States, the operation is often performed for hygiene reasons on infants.

Thousands of young boys are circumcised every year in Germany, especially in the country's large Jewish and Muslim communities.

The court specified that circumcision was not illegal if carried out for medical reasons.

Slogan: An eye for an eye makes the whole world blind (unless you are a fly)

They are agreeing that they have a right to mutilate babies. It's such a common sense issue. Allow boys to grow old enough to make their own informed decision on whether they want a foreskin. This certainly shouldn't be an issue for Muslims. From what I just read, it's not mandatory but merely customary and there is no age specification.

Its not the same one but its the same thing. They agree that its a religious issue.

thing is we have long since banned many other forums of mutilation (and sacrifices) in religion - its time for this one to go too. They never want to let it go though do they.

I voted yes, for multiple reasons, but mostly because it MASSIVELY reduces the chance of catching AIDs and other sexually transmitted diseases.

Male Circumcision Reduces HIV Risk: No Further Evidence Needed, According To Review

Oh, and also greatly improves sex. Got that from lots of females, and even several guys that had a circumcision later in life.

Also, I would like to add, that it is in no way comparable to female circumcision.

In a female, it removes the ability to orgasm, in males it reduces sensitivity, hence increasing the length of time before ejaculation.

This is one of those 'not as bad as' moments. Female circumcision is 'not as bad as' outright murder, therefore it's a topic unworthy of discussion?

I'm pretty sure anybody will agree that female genital mutilation is much more barbaric than the foreskin snip. That doesn't mean that male circumcision is too trivial to discuss.

Not much more, it is not even the same thing in any way, shape, or form.

Circumcision for females removes a woman's ability to enjoy sex, by removing the nerve center in a woman's vagina, leading to all sorts of bad health issues

For males, it is a removal of extra skin, that not only improves sexual health, it reduces the chances of getting STDs

For women is a tragedy that destroys health over a lifetime, for men it is a gift that improves health over a lifetime.

IMO, those against MALE circumcision are 100% retards, and are putting forth a knee jerk response, caused by political correctness, rather than taking a look at the everything and making a decision based upon facts and reasoning.

Circumcision of men would probably do more to improve the health of everyone in poor countries, than just about any other aspect that could be put forth, even immunizations. It is that beneficial and helpful in prevents STDs, which are rampant across 3rd world countries.

It is tragic, that people speak out against it, based upon false information and ignorance, but I shouldn't be surprised, given how those that cling to political correctness tend to ignore both reason and scientific research when it doesn't support their personal bias.

And just to provide some context, I have had this discussion quite a bit, both with men that have not been circumcised, and then were, as well as several women that were circumcised.

The men agreed it was good, and the women agreed it was horrible. Pretty much across the board.


I fully feel, that those speaking out against MALE circumcision, are doing so out of ignorance or an anti-religious bias, because you sure as shit arn't doing so based upon facts.
